Terms of service

Please carefully read below
on the type of commission
you are looking for!

All payments to be paid upfront and in USD through Square invoicing
You are expected to read and understand my TOS and general prices
Prices are subjected to change/increase based on the commission type and requests made by the client
I have the right to decline if it is beyond my capabilities or I am uncomfortable doing it
Communication will be through twitter dm @konppei or email at [email protected]
Watermarked and low resolution commissions may be used for portfolio purposes (please let me know if you want it to be private!)
You may display my work on external sites as long as you give visible credit (twitter@konppei) that is linked back to me
I may stream the process of the commission piece on my twitch channel (again, please let me know if you want the commission to be private)
For any inquires, please note that my response rate is 1-3 business days
I will update you multiple times throughout the process with watermarked screenshots, so please do not rush me
By paying the invoice, you are accepting to my terms and conditions

Estimated turnover: 1-2 months at start of sketch process	Estimated turnover: 3-5 months at start of design process
My style may be inconsistent for different types of commissions	My style may be inconsistent as these are hand made per order
Before I send the final file, you are allowed a maximum of 2 minor revisions after the coloring stage	NO REVISIONS after client has confirmed the design of the plush

Digital	Physical
Nothing is ever intended by either me or the Client, to be physically shipped to them	All packages are insured and will be delivered via USPS. All shipped goods will come with an insured tracking number. Any lost packages will not be my liability. Please contact your local post office if you are missing a package.
I am not required ever to ship any item unless it was explicitly discussed	You are responsible for any tax or custom fees the package may incur upon receiving the goods.

NO REFUNDS after approval of rough sketch; refunds will only be issued if I have not started on your commission or I am unable to complete it
I am not responsible for any mistakes that are made on your part over the course of the transaction/payment
You are NOT authorized to issue a chargeback for any reason
If for any reason your credit card account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue
Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone using your account, including side accounts
You are required to contact me when you need to cancel a commission request
Any fees, including shipping fees, are already included within the invoiced amount

All commissioned pieces are for personal use. Please reach out to me on twitter for commercial work
Commercial based work is subjected to +100% price increase on top of the base price (twitch, pngtuber, youtube, patreon, social media sites, business cards, banners, etc)
You may not modify, distribute, post the piece to any blockchain related network, or claim my artwork as your own. You and/or your partner(s) may NOT use this work for anything AI training related.
You may not create physical reproductions of personal commissions for sale - you may only reproduce for your PERSONAL use only
I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with the art (eg. post it to other sites such as Instagram) but will give proper credit to you for ownership of the character’s design
In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon
Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client
